These Terms & Conditions govern your use of https://strokeofhope.co.za(the “site”), operated by BotAndBotty as Stroke of Hope. By accessing or using the site you agree to these terms. If you do not agree, please do not use the site. Purchases are also subject to our Terms of Sale and Privacy Policy.
1. Acceptance
By using the site, placing an order, or ticking the box to accept these terms at checkout, you confirm that you have read, understood and agree to be bound by them.
2. Eligibility
You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to make a purchase. By transacting you confirm that the information you provide is accurate and that you are authorised to use the payment method chosen.
3. Your account & sign-in
We use passwordless, one-time-code (OTP) sign-in. You are responsible for keeping access to your email and phone secure, and for activity that takes place under your account. Please tell us promptly if you believe your account has been accessed without your permission.
4. Acceptable use
You agree not to:
- use the site for any unlawful, fraudulent or harmful purpose;
- attempt to gain unauthorised access to the site, its systems or other users’ data;
- interfere with or disrupt the site, or introduce malicious code;
- scrape, copy or reproduce the site’s content except as expressly permitted; or
- do anything that could harm the young artists we represent, or attempt to contact them other than through us.
5. Intellectual property
Copyright in each artwork remains with the artist who created it. Buying a physical piece transfers ownership of that physical object — it does not transfer copyright or any right to reproduce the work commercially.
The site’s own content — including the Stroke of Hopename, branding, text, layout, photography and design — is owned by or licensed to us and is protected by law. You may not use it without our written permission.
6. Links to other sites
The site may link to third-party websites (for example, our payment provider). We are not responsible for the content or practices of those sites, and a link does not imply our endorsement.
7. Availability & “as is”
We work hard to keep the site available and accurate, but we provide it “as is” and “as available”. We do not warrant that the site will always be uninterrupted or error-free, and we may change, suspend or withdraw parts of it at any time.
8. Limitation of liability
To the fullest extent permitted by law — and without excluding or limiting anything that may not lawfully be excluded under the Consumer Protection Act, 2008 (CPA) — we are not liable for any indirect, incidental or consequential loss arising from your use of the site. Nothing in these terms removes any right you have that cannot lawfully be removed under the CPA or other applicable law.
You agree to indemnify us against claims arising from your unlawful use of the site or your breach of these terms, to the extent permitted by law.
9. Governing law & disputes
These terms are governed by the laws of the Republic of South Africa. We would like to resolve any concern directly and fairly — please contact us first at bot@botandbotty.com. Any dispute that cannot be resolved that way will be subject to the jurisdiction of the courts of South Africa.
10. Changes to these terms
We may update these terms from time to time. The version shown here, with the “Last updated” date above, applies to your use of the site. Continued use after a change means you accept the updated terms.
